Terms of Use

These terms govern your use of the Blue Haven Interior Design website. By browsing this site or sending us an enquiry through it, you agree to them. If you do not agree, please do not use the site.

1. Business information

The following disclosure is made in terms of section 43(1) of the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), which requires anyone offering goods or services through a website to identify themselves clearly.

2. This website does not sell anything

Nothing on this website is an offer capable of acceptance, and no transaction can be concluded through it. There is no shopping cart, no checkout and no payment facility. The site is an online brochure whose purpose is to show our work and let you start a conversation with us.

A binding agreement between us comes into existence only when a written quotation or design agreement, signed or expressly accepted by both you and Blue Haven Interior Design, is in place. Until then, neither of us is committed.

3. Prices, quotations and the scope estimator

• Every project is individually priced after a site visit or a detailed brief, because materials, dimensions, access, existing conditions and finishes vary enormously between properties.
• A formal quotation is valid for the period stated on it, and where no period is stated, for 30 days from its date.
• Quotations are based on the scope described in them. Changes you request after acceptance ("variations") may change the price and the timeline, and we will confirm any such change with you in writing before proceeding.
• Timelines given on this website and in quotations are good-faith estimates. They can be affected by material lead times, supplier delays, access to site, weather and other matters outside our control.

4. Your consultation request

When you submit the consultation form, your own email application opens with the request prefilled and addressed to us. Nothing reaches us until you press send in your email app. Please make sure the details you send are accurate — particularly your phone number, since that is how we usually respond.

We aim to respond to enquiries within one business day, and generally faster on WhatsApp during business hours. We cannot guarantee a response time, and an unanswered enquiry does not create any obligation on our part.

5. Consumer rights

Where the Consumer Protection Act 68 of 2008 ("CPA") applies to our dealings with you, nothing in these terms limits, excludes or waives any right you have under that Act. In particular:

• You have the right to fair, honest and reasonable dealing, and to information in plain language.
• Section 16 of the CPA gives you a five business day cooling-off right in respect of an agreement concluded as a result of direct marketing. Note that an agreement you initiate by contacting us yourself is generally not a direct-marketing agreement, so the cooling-off right will usually not apply. Any cooling-off, cancellation or deposit terms specific to your project will be set out in your written agreement with us.
• Section 54 entitles you to services performed in a manner and of a quality that persons are generally entitled to expect. If we fall short, tell us and we will put it right.

6. Portfolio images and intellectual property

All content on this website — including the project photographs, the written descriptions, the logo, the layout and the design of the site itself — belongs to Blue Haven Interior Design or is used with permission. It is protected by the Copyright Act 98 of 1978.

• The photographs in the portfolio are of work completed by Blue Haven Interior Design.
• Photographs are published with the property owner's permission and, unless we have their agreement, do not identify the client or the property address.
• You may view, download and print pages from this site for your own personal, non-commercial use in considering our services.
• You may not reproduce, republish, resell or use our images or text for any commercial purpose, or present our work as your own, without our prior written permission.

Design drawings, renders, layouts, specifications and material schedules we prepare for you remain our intellectual property until they are paid for in full in terms of the applicable agreement, and may not be issued to another contractor for pricing or execution without our written consent.

7. Acceptable use

You agree not to:

• use this website for any unlawful purpose, or in a way that could damage, disable or impair it;
• attempt to gain unauthorised access to the site, its hosting infrastructure or any connected system;
• send us unsolicited commercial communications, spam or bulk marketing through the enquiry form, WhatsApp or email;
• use automated systems to scrape, copy or monitor the site or its images.

8. Availability of the website

We do our best to keep the site available and up to date, but we do not guarantee uninterrupted or error-free access. The site is hosted by a third party and may be unavailable for maintenance or for reasons outside our control. We may change, suspend or withdraw any part of the site at any time without notice.

9. Limitation of liability

The information on this website is provided for general information about our services. While we take care to keep it accurate, we do not warrant that it is complete, current or error-free.

To the maximum extent permitted by law, and subject always to your rights under the Consumer Protection Act, Blue Haven Interior Design is not liable for any indirect or consequential loss arising from your use of this website, from reliance on the indicative information in the scope estimator, or from any inability to access the site. Nothing in these terms excludes liability for gross negligence, fraud, or death or personal injury caused by our negligence, and nothing here limits our obligations under a signed project agreement.

10. Third-party links

This website links to third-party platforms, including WhatsApp. We do not control those platforms and are not responsible for their content, their availability or their treatment of your information. Following such a link is at your own discretion.

11. Privacy

Our handling of your personal information is governed by our Privacy Policy, which forms part of these terms. Requests for access to information are dealt with under our PAIA Manual.

12. Complaints and disputes

If you are unhappy with our service or with anything on this website, please raise it with us first at info@bluehavendesigns.co.za or 078 476 9221 · 079 666 7206. We will acknowledge your complaint and work with you in good faith to resolve it.

If it cannot be resolved between us, either of us may refer the dispute to mediation before taking it further. Where the Consumer Protection Act applies, you may also refer the matter to the National Consumer Commission or to a recognised consumer court or ombud. This does not affect either party's right to approach a court of competent jurisdiction.

13. Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them or from your use of this website.

14. Changes to these terms

We may amend these terms from time to time. The version published here, bearing the revision date at the top of the page, is the version that applies to your use of the site.
